TERMS AND CONDITIONS OF PURCHASE

These general terms and conditions (”Terms and Conditions”) apply when you as a consumer (“You”) place an order via https://ilvesshoes.com/en and related pages (”Website”). An agreement is entered into between You and L & P Nierenburg AB, organisation number 556332-2899 (”Ilves Shoes”).

Detailed contact information and other information about ILVES SHOES can be found on the Website. The terms are only applicable to You who are a consumer placing orders via the Website.

To be able to order on the Website, you must be 18 years of age. According to Swedish law, ILVES SHOES does not accept credit purchases from persons under the age of 18. GRANINGE SHOES reserves the right to deny or change your order in individual cases (for example if You have provided incorrect personal information and/or have a record of non-payment).

ILVES SHOES accepts no liability for items being sold-out or for any image or typographical errors on the Website, for example errors in the product description or technical specifications, incorrect prices and price adjustments (such as changes in prices from suppliers or currency fluctuations), or incorrect information regarding whether an item is in stock. ILVES SHOES has the right to correct any errors and to change or update the information at any time. If an incorrect price has been stated for an item You have ordered, ILVES SHOES will of course notify You of this and await your confirmation of the new price before proceeding with the order. All image information on the Website should be seen as illustrations only. Such illustrations cannot be guaranteed to reflect the number of items You will receive or the exact appearance, functions, or origin of the item. ILVES SHOES is not responsible for information on the Website that comes from a third party.

The website and content on it is owned by ILVES SHOES or its licensors. The information is protected by, among other things, intellectual property law and market law. This means that trademarks, company names, product names, images and graphics, design, layout, and information about goods, services, and other content may not be copied or used without written approval from ILVES SHOES.

  1. AGREEMENT AND ORDERING

In order to make a purchase via the Website, You must accept the Terms. By accepting the Terms and Conditions, You agree to comply with the Terms and Conditions in their entirety, and agree that you have read the information about personal data and consented to the use of personal data and cookies as stated in ILVES SHOES’ Data Protection Policy, see here.

A purchase agreement is only concluded when ILVES SHOES has confirmed your order and you have received an order confirmation from ILVES SHOES by e-mail. ILVES SHOES urges you to save the order confirmation for any contacts with ILVES SHOES’ customer service. You can cancel your order until it has been confirmed by ILVES SHOES. If the order is cancelled, ILVES SHOES will refund any payments that You or your debit or credit card company have made relating to the order.

3. PRICES, FEES, AND PAYMENT

When ordering via the Website, the prices shown on the Website apply. Prices are in SEK (Swedish kronor) and include VAT. The prices do not include payment or shipping fees, which are given separately.

3.2
You can pay in the ways specified on the Website. ILVES SHOES has the right to charge you when you place the order, unless you opt to pay by invoice or similar payment method which has been approved by ILVES SHOES. In case of invoice payment or partial payment, ILVES SHOES or its partners may check your credit score. You will then be informed of this. ILVES SHOES reserves the right not to always offer all payment methods, alternatively change payment methods if what You selected for any reason does not work at the time of purchase. Please note that any restrictions on payment options are shown on the Website.

4. PROMOTIONS AND OFFERS

ILVES SHOES may from time to time offer promotions on the Website with Terms that are more favourable than those set out in these Terms and Conditions, e.g. concerning payment or extended right of withdrawal. These more favourable terms apply for as long as the promotion is active and for the specific items indicated by ILVES SHOES in connection with the campaign. ILVES SHOES reserves the right to withdraw such promotions at any time. Upon termination or withdrawal of a promotion, these Terms and Conditions shall apply without modification. Offers on specific items on the Website are valid for a limited time and while stocks last.

5. DELIVERY AND TRANSPORT

5.1
Items in stock are normally delivered within the number of working days specified on the Website. Unless otherwise specifically agreed (e.g. in connection with the booking of out-of-stock items) delivery will take place no later than 30 working days after ILVES SHOES has issued a written order confirmation.

5.2
The expected delivery time of the item is shown on the order confirmation, at the checkout, and/or the relevant product page on the Website. Unless otherwise specifically agreed and a delivery takes more than 30 working days, and this is not due to You as customer, you have the right to cancel the purchase.

5.3
If a parcel is to be collected You must do so within the time specified in the delivery notification. Parcels should normally be collected in person with valid identification and order number. You will always receive a notification showing where and when the parcel should be collected. Notification can be via email, regular mail, or by phone call or SMS. If you do not pick up the parcel, ILVES SHOES has the right to charge a fee of SEK 149.

6. RIGHT OF CANCELLATION

6.1
When purchasing items on the Website, you have the right to withdraw your order within 30 days. This means that you have the right to cancel your purchase by notifying ILVES SHOES within 30 days from the date You or your proxy received the ordered goods (withdrawal period). Please use the enclosed return label.

6.2
In connection with ordering an item for which the right of withdrawal does not apply, you will receive clear information about this.

6.3
In exercising the right of withdrawal You are responsible for the condition of the item after You have received it and during the return shipping. The item mut be sent back within 30 days from the date ILVES SHOES received the notice of cancellation. The item must be sent well packaged, unused, in its original condition and its original packaging, with labels and tags still attached. Returns should be made to ILVES SHOES. Please use the return label provided.

6.4
When You cancel your purchase, ILVES SHOES will refund the amount paid by You for the item, including delivery costs. Exceptions apply to any additional delivery costs resulting from your choice of delivery method other than the standard delivery offered by ILVES SHOES. When returning part of an order, the delivery cost is not refunded. On the amount to be repaid, ILVES SHOES has the right to deduct an amount corresponding to the depreciation of value of the item compared to the original value, if and to the extent that such depreciation is due to the fact that You have handled the item more than necessary to determine its features or function.

ILVES SHOES will refund the amount as soon as possible, but no later than 14 days from the day we received your return. The refund will be made to you via the payment option you chose when you purchased the item, unless otherwise agreed or there are obstacles to such a refund.

7. WARRANTY AND CLAIMS

7.1
Some ILVES SHOE products may be covered by warranty. Information about the possible warranty period and specific warranty conditions for each product can be found on the Website or in these Terms and Conditions. Product warranty only covers manufacturing defects, and thus not defects arising from or following a change by You in the function or appearance of the item, such as rebuilding, upgrading, or another configuration of the product. Your order confirmation serves as proof of warranty.

7.2
The warranty covers items that are defective in accordance with current consumer protection legislation. If you discover that the product is defective when you receive your order, you should contact ILVES SHOES as soon as possible, but no later than 14 days after you receive your order. Please contact our customer service. Complaints made within two months of You discovering the defect will always be considered to have been submitted on time. You have a three-year warranty on items purchases from the Website.

7.3
ILVES SHOES will pay the return freight for accepted claims.

7.4
Once the item has been returned and the claim is accepted, ILVES SHOES will recompense You in accordance with current consumer protection legislation. ILVES SHOES aims to do this within 30 days of receiving the claim, but it may take longer depending on the nature of the product. ILVES SHOES reserves the right to refuse a claim if it turns out that the item is not defective in accordance with current consumer protection legislation. For claims, ILVES SHOES follows the recommendations of the National Board for Consumer Disputes (ARN), see www.arn.se. Further information is available at www.konsumentverket.se.

8. LINKS

ILVES SHOES may link to other websites that are beyond ILVES SHOES’ control, and websites outside ILVES SHOES’ control may link to the Website. Although ILVES SHOES seeks to ensure that ILVES SHOES only links to websites that share ILVES SHOES’ privacy and security practices as set out in the Data Protection Policy, ILVES SHOES is not responsible for the protection or privacy of information or personal data You provide on other websites. You should exercise caution and read the privacy policy of the relevant website.

9. FORCE MAJEURE

ILVES SHOES is not liable for delays caused by circumstances beyond ILVES SHOES’ control, such as general labour disputes, war, fire, lightning, terrorist attacks, changes in government regulations, technical problems, faults in electricity/telecommunications/data connections or other communications, as well as faults or delays in services from subcontractors due to circumstances listed here. These circumstances shall constitute grounds for exemption from damages and other penalties. Should such a situation arise, ILVES SHOES will inform You both at the beginning and at the end of the time of the situation in question. If the circumstance has lasted longer than two months, both You and ILVES SHOES have the right to cancel the purchase with immediate effect.

10. CHANGES TO THE TERMS AND CONDITIONS

ILVES SHOES reserves the right to make changes to these Terms and Conditions at any time. All changes to these Terms and Conditions will be published on the Website. Changes apply from the time You have accepted the Terms and Conditions (in connection with a new purchase or when visiting the Website), or 30 days after ILVES SHOES has informed You of the changes. However, ILVES SHOES recommends that You keep yourself updated on the Website regularly to be aware of any changes to the Terms and Conditions.

11. INVALIDITY

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a competent court, authority, or arbitration board, the provision in question and all other provisions shall be valid and enforceable to the extent permitted by applicable law. The provisions declared invalid or unenforceable will be replaced by relevant legal guidance and advice.

12. APPLICABLE LAW AND DISPUTES

12.1
Disputes shall primarily be resolved by mutual agreement after discussion with ILVES SHOES’ customer service.

12.2
If a dispute cannot be resolved in agreement with ILVES SHOES’ customer service, You as a customer can turn to the National Board for Consumer Disputes (ARN). Further information about ARN is available at www.arn.se. You can also file complaints directly online via the European Commission’s Dispute Resolution Platform, which you can find via this link https://ec.europa.eu/consumers/odr. If You submit a complaint via this platform, your case is automatically forwarded to the appropriate national dispute resolution body. The dispute resolution body will then contact us and try to resolve the dispute without ging to court.

In the event of a dispute, ILVES SHOES follows the decision from ARN or an equivalent dispute resolution body.

12.3
Disputes regarding the interpretation or application of these Terms and Conditions shall be interpreted in accordance with Swedish law and settled in accordance with section 12.2 above or ultimately in a general court. In case of any discrepancy between the English and Swedish versions of the Terms and Conditions of Purchase, the Swedish version shall prevail.
